Why we celebrate Public Domain Day?
Every year, 1 January marks not only the start of the new year, but also Public Domain Day. On this day, works whose copyright has expired by that date enter the public domain. This means that we can use such works without restriction, without asking permission or paying any fees.
The public domain is a collection of creative works for which the exclusive intellectual property rights have expired or never existed. There is no exact information about the establishment of this holiday. The first documented mention came in 2004 through Canadian public domain activist Wallace McLean. His idea for the holiday was encouraged by other activists and Lawrence Lessig (founder of Creative Commons).
What Do People Do?
The timing and procedure for transferring works into the public domain is regulated by the states themselves. It usually takes between 50 and 70 years from the author’s death. On 1 January many websites and journals publish a list of works that have fallen into the public domain. This day is supported and promoted by various organisations such as the Open Knowledge Foundation, Creative Commons and Project Gutenberg. These organizations hold events dedicated to works in the public domain. These events may be held in libraries or universities.
Creative Commons has developed a symbol to identify works in the public domain. The symbol is a combination of a copyright character and a “no”. This symbol can be found on around 3 million works.

Interesting facts about the public domain
- The ancient Romans first thought of the public domain. They used the terms res communes, res publicae and res universitatis to denote various property rights.
- The first copyright law appeared in 1710 in Britain, the Statute of Anne.
- The modern concept of the public domain was introduced by the French and English in the eighteenth century.
- The longest copyright term belongs to Mexico. Specifically – it has life plus 100 years for all deaths since July 1928.
- Patents have the shortest term of copyright. In many countries this term is 20 years.
